A parenting plan is the document that outlines each parent's roles and responsibilities in the upbringing of the child, as well as establishes a residential schedule. Child support allocations are typically also included in this document.
At Harper, Evans, Hilbrenner & Netemeyer, we have more than 100 years of combined experience handling child custody matters. Our lawyers can help you understand all of the options available and guide you toward a carefully crafted parenting plan that truly serves your child's best interest.
A parenting plan must comply with the requirements of Missouri law. In general, a parenting plan will designate the physical custody arrangement and set forth the times at which the child will be in each parent's care. It will also allocate legal custody that pertains to the decision-making rights and responsibilities of the parents. In Missouri, there is a legislative preference for joint legal and joint physical custody awards. This means that, in many cases, parenting plans allocate substantial time to each parent and provide for shared decision-making.
However, in some cases, the best interests of the child or children may require a very different custodial plan. When allegations of abuse or neglect arise, our attorneys will fight to protect your child. Our child custody attorneys have extensive experience working with child welfare professionals, Children's Division and juvenile offices. There are no second chances to protect your child's best interest. Our attorneys understand that, when it comes to your child, protecting him or her from a neglectful environment or abusive parent must be successful.
Overall, the only true limit to what a parenting plan will look like is that it must be in the best interest of the child. The child's needs should always come before those of either parent. Beyond that, a Missouri parenting plan attorney can be as creative as necessary to do what is right for your family. We encourage a detailed approach to the crafting of a parenting plan to maximize the potential that it will stand the test of time, and will be an effective document in settling disputes if, as and when they arise between parents after the case is over.
