  • What benefits am I entitled to if injured from a car accident?

    If you are injured as a result of a car accident then you are entitled to accident benefits. Accident benefits are covered under your own auto insurance policy. These include:


    • Income Replacement
    • Medical and Rehabilitation
    • Attendant Care
    • Housekeeping
    • Death Benefits
    • Non-earner Benefits
    • Caregiver Benefits

    If you were not at fault, you may also file a tort claim against the driver, subject to your meeting certain criteria. This would cover certain losses that your own insurance company doesn’t cover, such as pain and suffering. It is best to consult with a car accident lawyer to review the specifics related to your case.

  • What if I was the passenger in a car accident? Can I still make a claim?

    Yes. You can make a claim for accident benefits from your own auto insurance company if you have an auto policy, or from the insurance company of the vehicle you are in if you don’t have your own auto insurance policy. You can also bring a tort claim for pain and suffering against the driver of the vehicle you were in if they were at fault for the accident.You may feel uncomfortable filing a tort complaint against the driver of the vehicle, especially if you have a close relationship with the driver. However, the driver's insurance policy will also cover the losses of any passengers that are in the vehicle at the time of the accident.

  • What do I do if I am at-fault for a car accident? Can I still make a claim?

    Yes. Whether you are at-fault or not, if you are injured as a result of the car accident than you can still make a claim with your insurance company and are entitled to accident benefits.

  • What if the accident occurred while I was working?

    It’s important to contact a personal injury lawyer as soon as possible. He/she can then determine whether your claim should be pursued through the insurance company or the WSIB (Workplace Safety Insurance Board).

  • What if I was involved in a hit-and-run?

    If you are the driver or passenger involved in a hit and run, you can make a claim for accident benefits from you own or the driver’s auto insurer. If you are not at fault for the accident, and the at fault vehicle has fled the scene (is unidentified) you can also bring a tort claim and would involve your auto insurance company or the auto insurance company of the driver of your vehicle. If you are a pedestrian victim in a hit and run, and/or there are no other auto insurance policies that can respond to the claim, there is insurance available to you through the motor vehicle accident claims fund.

  • What is the Motor Vehicle Accident Claims Fund?

    This is what is referred to as the “payor of last resort” for motor vehicle related claims. Meaning, this is the last place to apply to for accident benefits if no other insurance is available.


    The Motor Vehicle Accident Claims (MVAC) Fund provides compensation to people who are injured as a result of automobile accidents when no other insurance policy exists to “respond” to the claim. This includes accident benefits claims and tort claims (third party claims).


    How does this work? The MVAC Fund is for claims involving accident victims who were involved in an accident with an uninsured or unidentified driver, or a stolen vehicle, when no liability (at fault) insurance exists.


    If you are the victim of a hit and run for example, and you do not have any insurance available to you or information on the driver, you would make an application for accident benefits to the Motor Vehicle Accident Claims (MVAC) Fund.


    The MVAC provides compensation for personal injury and property damage claims. It is important to note that there is a limit to how much money you can recover.

  • Do I need a lawyer if I was in a car accident?

    While you don’t need a lawyer, it is advisable to consult with a lawyer to understand your rights. It is important to hire a car accident lawyer if you have a dispute with your insurance company and/or think you want to make a tort claim against the at-fault driver. A car accident lawyer can help you try to recover compensation from the insurance company for benefits such as treatment, lost wages, housekeeping and childcare.
